Intelex USA, LLC d/b/a Warmies (“Intelex” “we”, “our” “us”) designs products to bring comfort to everyday life. Your privacy is important to us, and we will work to keep the information you provide to us secure.
This Privacy Policy (“Policy”) explains how we collect, use, secure, and disclose (“Process”) information about you that can personally identify you, either on its own or when combined with other information (“Personal Information”), when you use our websites, mobile and tablet applications, and other online products and services that link to this Policy, subscribe to our print newspapers, receive our emails and newsletters, attend our events or otherwise interact with us (our “Products”).
By using the Products and providing us with Personal Information, you agree to the practices described in this Policy and our Terms and Conditions, and to the updates to these policies posted here from time to time. To make sure you stay informed of all changes, you should check these policies periodically. Updates will be referenced by the “Last Updated” date shown above.
Our Products may contain links to other websites, applications or services that are not owned or controlled by us, including links to social media platforms, or may redirect you off our Products to other locations for information or other services. We are not responsible for the privacy and security practices of other websites, applications or social media platforms or the information they may collect. You should refer to such third parties’ privacy policies to determine their respective privacy practices. Links to any other websites, applications, social media platforms, or other content do not constitute or imply our endorsement or recommendation of the linked website, application, Social Media Platform, and/or content.
Depending on where you live and other factors, our Processing of your Personal Information may be subject to the California Consumer Privacy Act (CCPA) and other U.S. data privacy laws. The laws may give you certain rights to access your Personal Information and opt out of some of our Processing practices. Our “California and Other U.S. State Privacy Laws” Policy describes what rights you may have under those laws. It is our intent to comply with all laws and regulations that cover your Personal Information.
I. What Information Do We Collect from You?
We may Process the following categories of Personal Information about you when you use our Products. How we collect or receive this information depends on the context, including the Products you use, or your device or account settings. Not all categories of information will be collected or received about every individual.
Personal Identifiers We may collect information you provide to us when you register an account with us or sign up for a service; subscribe to a newsletter or purchase a product; when you participate in a contest, promotion or survey; or fill out a webform. This information includes:
• contact information such as name, email address, postal address and telephone number(s);

Commercial Information When you shop for and purchase our Products on our site, we keep track of the Products you looked at and bought, so we can show you relevant Products the next time you shop with us.
Automatic Network Activity When you come to our site or use our Products, we may automatically collect certain information, including:
• Usage Information: We may track, collect, and aggregate information indicating, among other things, which pages of our Site were visited, the order in which they were visited, when they were visited, and which hyperlinks were clicked. We also collect information from the URLs from which you linked to our Site. Collecting such information may involve logging the IP address, operating system, and browser software used by each user of the Site, device and advertising identifiers;
• Video Viewing Information: We may collect information concerning your engagement with and consumption of videos, video content and URLs on our site, including whether you requested or viewed specific video materials or services.
We and our service providers may use cookies, pixels, web beacons, and other similar technologies to gather information about your browser and your interests when you visit our site and use our Products. Most web browsers are set to accept cookies by default. If you prefer, you can go to your browser settings to learn how to delete or reject cookies. If you choose to delete or reject cookies, this could affect certain features or services of our websites. If you choose to delete cookies, settings and preferences controlled by those cookies, including third party targeted advertising preferences, may be deleted and may need to be recreated.
Location Information We may be able to determine from an IP address a user’s Internet Service Provider and their general geographic location. Location data may be used to route your traffic to the nearest regional server to reduce latency and improve your experience. Some of our apps can provide content based on your GPS location if you enable this feature.
Our Chat Features You may engage with us through our automated chat functions. We may deploy a chatbot or other functionality on our sites for customer service or for other business purposes. As described further below, by using and engaging with the chatbot or chat function, you acknowledge that you are not interacting with a human being and consent to the recording and use of information about you and the chat session or any authorized service provider acting solely on our behalf. You further agree that we may use or disclose the information you provide via the chatbot or chat function in accordance with this Privacy Policy. If you do not consent to these terms, you should not use the chatbot or chat functionality. Your continued interaction with, or submission of information to, any chat feature will be deemed your acceptance of this provision.
Your Content We offer you the ability to post content in certain contexts, or to share information with us held on other platforms. This information may include:
• User-generated content such as communications and opinions in chat rooms, message boards, forums, surveys, polls, and online forms;
• Photos or videos that you upload to the Site;
• Data held by you on social media platforms and other software (for example, access to your contacts, calendar or photos). At your request, information about your friends, family and acquaintances, including their contact information. By doing so, you acknowledge and agree that you have everyone’s consent for us to use their contact or other information for the purpose for which it was provided, and that such information is accurate.
• Any additional information when we collect your data with your consent.
Inferences We may create or generate new information about you from other data we collect, including using automated means to generate information about your likely preferences or other characteristics.
De-Identified Information We may aggregate and/or de-identify any information collected through our provisions of the Products so that such information can no longer be linked to you or your device (“Aggregate/De-Identified Information”). We may use Aggregate/De-Identified Information for any purpose, including without limitation, for research and marketing purposes, and may also share such data with any third parties, including advertisers, promotional partners, and sponsors, in our discretion.
Children Our Products are intended for a general audience and are not directed at children under eighteen (18) years of age. We do not knowingly gather personal information (as defined by the U.S. Children’s Privacy Protection Act, or COPPA) in a manner not permitted by COPPA. Sensitive Personal Information In general, when we provide our Products, we do not Process Sensitive Personal Information, as that term is defined in the CCPA and other U.S. state privacy laws.
II. What Information Do We Collect From Other Sources?
In addition to the Personal Information you provide us by using our Services, we also collect Personal Information from the following sources:
Publicly available sources As permitted by law, including contact information, demographic and professional data and interests.
Social Media Platforms If you interact with us through a social media platform (like Facebook or TikTok) or log in using social media credentials, we may have access to your information from that service, such as your login-information, profile name, name, email address, friend or followers/following list, profile and demographic information, activities on the social media platform (such as “likes” shares, reposts, clicks), location, comments about or reactions to our Products, and the people/sites you follow.
Please review the privacy policies of the applicable third-party or social media platform for their privacy practices and for instructions on how to control your privacy settings within those platforms.
Advertising Partners and other Third Parties Marketing, data analytic privately-owned databases give us access to a range of information — like public data, survey data and more. This data sometimes includes your mailing address, your gender, your age, your household income and other demographic data.
III. How Do We Use the Information Collected About You?
We Process the Personal Information you provide to us and that we collect from other sources for the following purposes:
To provide and manage the Products This includes making our Products available to you in print or digital form, arranging access to your account, completing your payments and transactions, understanding and resolving technical issues with your account or our Products.
To contact you We may use your Personal Information to provide you with service-related messages (i.e., a change in our terms and conditions), to respond to your customer service or other inquiries, to send you emails, newsletters or alerts (based on your registrations and preferences) or to notify you of promotions, contests, surveys or events we think may be of interest to you. You may unsubscribe from our promotional emails at any time.
To improve or develop our products and services We may use your Personal Information to make business and marketing decisions, assess customer satisfaction, or to otherwise improve our Products.
To market and advertise our Products to you We may use your Personal Information to market our Products to you. We may serve you ads through websites, locations, platforms and services that are owned and operated by third parties. Sometimes, we use marketing vendors to advertise to you on our behalf. We may send you targeted or promotional emails. You may unsubscribe from our promotional emails at any time.
To customize and evaluate your experience We and third parties may use your Personal Information to deliver you ads, promotions and offers by third parties that may be personalized to you. We also use this information to measure the effectiveness of ads and to help recognize your devices to serve you ads on and off the sites. To do so, we and third parties may:
• Use ad-tracking technologies: To serve you personalized advertisements on behalf of advertisers third parties and we may use ad tracking technologies like cookies. For example, the websites use cookies to help keep track of items you put into your shopping cart including when you have abandoned your cart, and this information is used to determine when to send cart reminder messages via SMS.
• Build demographic models. We may combine your Personal Information with information from other users of our Products to build models that may measure users’ attributes, interests, or demographic information. We may use this demographic information to run targeted advertisements and marketing campaigns.
• Use affiliate links. We may use your information to make product recommendations to you and to provide you with links to other products and services not operated or controlled by us.
A note on third parties: Third party advertisers may combine information they gather about you through our Products with information they receive from their other clients. This may help them target advertisements to you on behalf of their other clients. Third parties may also use other services to serve you advertisements. We do not control these third parties’ privacy policies and cannot be responsible for them. Any Personal Information you provide to them is covered by their privacy policies, not ours.
For legal reasons or to carry out administrative tasks We may use the information you provide to us to audit our internal processes for legal, regulatory and contractual compliance requirements, and for security and fraud detection purposes.
With your consent We may use your information in other ways with your consent or at your direction.
IV. To Whom Do We Disclose or Share Your Personal Information?
We may share the Personal Information you provide to us:
Within our company: We may share your information with others within our corporate family of companies that are related by common ownership or control.
With Service Providers: We work with service providers to carry out certain tasks on our behalf, including:

SMS/Texting Campaigns We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your Personal Information, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.
Third Parties that Provide Advertising, Content or Other Functionalities We may share your Personal Information with third parties that provide advertising, content and other functionalities to us for the purposes disclosed in Section III above. This includes sharing your information with third parties for targeted advertising, to measure and analyze ad performance, to run sweepstakes or live events, or to improve and enhance our Product functionality.
The disclosure of your information to third parties for advertising purposes may constitute a “sale” or “share” of your information under the CCPA and other U.S. state privacy laws. Social Media Companies If you log into our Products with a social media service or if you connect a social media account with the Products, we may disclose certain of your Personal Information to that social media service depending on your settings. The social media service’s privacy policy then applies to their practices regarding your information.
When required by Law or as Necessary to Protect our Users or Products We may disclose your information as is necessary or appropriate to protect, enforce or defend the legal rights, privacy, safety, or property of the Products, our employees or agents or users, or to comply with applicable law or legal process, including to respond to requests from public or government authorities.
In Connection with a Corporate Transaction We may disclose your information in the event that we sell or transfer all or a portion of our business or assets to a third party, such as in the event of or in contemplation of a merger, acquisition or in connection with a bankruptcy reorganization.
V. How Do We Protect Your Information?
We use commercially reasonable procedures and various technical, administrative and physical safeguards to help protect the confidentiality of your Personal Information, but we cannot guarantee that your information is 100% secure. Therefore, although we believe the measures we have implemented reduce the likelihood of security problems to a level appropriate to the type of data involved, we do not promise or guarantee, and you should not expect, that your Personal Information or private communications will always remain private or secure. We do not guarantee that your Personal Information will not be misused by third parties, and we are not responsible for the circumvention of any privacy settings or security features.
