OFFICIAL RULES

1. Sponsor: Pompompurin Warmies Giveaway (the "Sweepstakes") is a game of chance where winners will be randomly chosen from those who enter.  Intelex USA, LLC 105 Prairie Lake Rd, East Dundee, Illinois, [email protected] (the “Sponsor”) is the Sponsor of the Sweepstakes and is responsible for all aspects of the Sweepstakes. Participation in the Sweepstakes constitutes the participant's full and unconditional agreement to these Official Rules, and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes.

2. Eligibility: The Sweepstakes is only open to participants who are legal residents of the United States, and who are 18+ years of age at the time of entry (the “Entrant”). Employees of the Sponsor, Sponsor’s affiliates, subsidiaries, advertising and promotion agencies, suppliers (“Affiliates”) and immediate family members and/or those living in the same household as any Employee or Affiliate, are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws and regulations, and is void where prohibited or restricted by law, rule, or regulation.

3. Sweepstakes Period: Entries will be accepted online starting on Apr 15, 2026 at 1:00pm CST and ending Apr 22, 2026 at 1:00pm CST (the “Entry Period”). All online entries must be received by Apr 22, 2026 at 1:00pm CST. All times are CST. Entries submitted before or after the Entry Period will not be entered, and are not eligible to win. Sponsor’s computer is the official timekeeping device for the Sweepstakes.

4. How to Enter:  No purchase is necessary to enter or to win. The Sweepstakes must be entered by liking the Warmies Giveaway post on Instagram and following @warmies_usa on Instagram. An additional entry can be made by commenting on the Pompompurin Warmies Giveaway post. There is no charge to enter. All Entrants must fulfill all Sweepstakes requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of the Sponsor. An Entrant may enter only once, unless additional steps are taken to obtain additional entries. Entrants may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the rules. If an Entrant uses fraudulent methods or otherwise attempt to circumvent the rules, the entry (or entries) may be removed from eligibility at the sole discretion of the Sponsor.

5. Qualifying Submissions: A parent/guardian must submit the entry for anyone who is under 18 years of age, and the parent/guardian must be the Entrant.

6. Winner: Three Sweepstakes winners are chosen by a random draw. Entrants who obtained multiple entries by taking the additional steps to do so will have increased chances of winning. 

7. Prizes: The approximate retail value of the prize is $34.99. The prize is: 1 Pompompurin™ Warmies. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution permitted except at Sponsor's discretion. The prize is nontransferable. Any and all prize related expenses, including without limitation any and all federal, state, and local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for the Sponsor to use the winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

8. Winners Notification: Winners will be chosen within two (2) days following the end of the Sweepstake entry period. Three (3) Winners of the Sweepstakes will be notified via instagram message from @warmies_usa within five (5) days following the winners selection to the username associated with the link or comment action. The Sponsor is not liable for a winner's failure to receive notices due to winners' spam, junk email or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 15 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, the prize may be forfeited and an alternate winner selected. The receipt by the winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

9. Rights Granted by you: By entering this Sweepstakes you understand that the Sponsor, anyone acting on behalf of the Sponsor, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the Sweepstakes, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

10. Terms: The Sponsor reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes should (in its sole discretion) a virus, bug, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such a case, the Sponsor may judge submissions from all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Terms & Conditions.

The Sponsor has the sole right, to maintain the integrity of the Sweepstakes, to void entries for any reason or no reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Sweepstakes rules; or the use of bots, macros or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. By entering the Sweepstakes, Entrant agrees to receive email newsletters periodically from the Sponsor. You can opt-out of receiving this communication at any time by clicking the unsubscribe link in the newsletter.

11. Limitation of Liability: By entering the Sweepstakes, Entrant agrees to release and hold harmless the Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, through negligence or intentional acts, caused by or arising out of (i) such Entrant's participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Sweepstakes; (v) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries.

12. Disputes: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF UNITED STATES AND THE STATE OF ILLINOIS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, Entrant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or relating to this Sweepstakes, shall be resolved individually, and not as any form of class action, exclusively before a court of proper jurisdiction located in Illinois. Further, in any such dispute, under no circumstances will Entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than Entrant's actual out-of-pocket expenses, if any, and Entrant further waives any and all rights to punitive, consequential, treble, or enhanced damages.

13. Privacy Policy: Information submitted by an Entrant with an entry is subject to the Privacy Policy stated on the Sponsor’s Website, located here: https://warmies.com/pages/privacy-policy.

14. This Sweepstakes is in no way sponsored, endorsed or administered by, or associated with Instagram, Facebook, Twitter, YouTube, Pinterest, LinkedIn, or Google. Sanrio, Inc. is not a sponsor of this sweepstakes and is released from all liability. You understand that you are providing your information to the Sponsor of this Sweepstakes and not to Instagram, Facebook, X, YouTube, Pinterest, LinkedIn, or Google. As such, each Entrant hereby releases and holds harmless Instagram, Facebook, X, YouTube, Pinterest, LinkedIn, or Google from all claims relating to this Sweepstakes.
